These Terms of Service apply when you book cleaning services from Summit Clean Ltd ("Supplier", "we", "us"). The client ("you", "Customer") agrees to these terms once a booking or contract is confirmed in writing (including by email).
1. Definitions
- Services: Cleaning services agreed in writing, including any agreed deliverables (e.g., checklists or reports).
- Business Day: A day other than Saturday, Sunday, or public holiday in England and Wales.
- Charges: Fees payable for the Services as agreed in writing.
- Operating Hours: Service times agreed for each booking/contract.
2. Supply of services
- We will provide the Services with reasonable care and skill.
- We will use reasonable endeavours to meet agreed schedules, but timings may vary due to access, site conditions, or circumstances outside our control.
- We will comply with reasonable site rules and security requirements communicated to us.
3. Client obligations
To enable us to deliver the Services, you agree to:
- Provide safe, timely access to the site and required areas
- Provide accurate information about the site and any relevant hazards/constraints
- Ensure utilities (water/electricity where required) are available
- Secure valuables and sensitive items prior to service
If our performance is delayed or prevented due to your acts/omissions (including lack of access), we may reschedule and/or charge for attendance/time lost where reasonably incurred.
4. Health & safety and site conditions
- You must inform us of any known hazards (including sharps, bodily fluids, pest issues, unsafe flooring, or restricted areas).
- Where specialist cleaning is required (e.g., biohazard, hoarding, trauma scenes), we must agree scope and pricing separately before work begins.
5. Materials and equipment
- We may use our own equipment and products unless agreed otherwise.
- If you request use of your materials or chemicals, you must notify us in advance. We may refuse where we consider it unsafe, non-compliant, or unsuitable.
6. Charges, invoicing and payment
- Charges are as agreed in writing.
- VAT is payable where applicable and will be shown on invoices.
- Payment terms (e.g., due on receipt / 7 days / 14 days) are as stated on the invoice or contract details.
- Late payments may incur interest and reasonable recovery costs as permitted by law.
7. Cancellations and rescheduling
- One-off bookings: cancellation/reschedule terms will be confirmed at booking.
- Contract services: notice requirements will be set out in the contract details.
- If cancellation is made without the agreed notice period and we have allocated staff/time, you may be charged for costs reasonably incurred.
8. Quality assurance and issues
- If you are unhappy with the Services, please notify us within 48 hours (or within 1 Business Day for daily contract services).
- We will investigate and, where appropriate, arrange a re-clean or corrective action within a reasonable time.
9. Liability
- Nothing in these terms limits liability that cannot legally be limited (including for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation).
- Subject to the above, our total liability arising from the Services will not exceed the total Charges paid for the Services giving rise to the claim.
- We are not liable for pre-existing damage, normal wear and tear, or issues arising from undisclosed site conditions.
10. Termination (contracts)
Either party may terminate a contract as set out in the contract details. We may terminate immediately if invoices remain unpaid beyond the agreed terms or if site conditions present safety risks.
11. Data protection
We handle personal data in accordance with our Privacy Policy.
12. Governing law
These Terms of Service are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
